Welcome to MyNextEx. These Terms of Service ("Terms") govern your access to and use of the MyNextEx website, mobile application, and related services (collectively, the "Service"). By using the Service, you agree to these Terms.

1. Eligibility

You must be at least 18 years old to create an account or use MyNextEx. By using the Service, you represent and warrant that you are 18 or older and legally able to enter into this agreement.

2. Your Account

• You are responsible for maintaining the confidentiality of your login credentials.
• You agree to provide accurate information and keep your profile reasonably up to date.
• You are responsible for all activity that occurs under your account.
• You may not transfer, sell, or share your account with another person.

3. Acceptable Use and User Conduct

You agree to use the Service lawfully and respectfully. You may not:

• Harass, threaten, stalk, intimidate, or impersonate other users.
• Post defamatory, obscene, hateful, sexually exploitative, violent, or otherwise unlawful content.
• Upload content that infringes another party's intellectual property, privacy, or publicity rights.
• Use the Service to solicit money, advertise unrelated services, run scams, or collect user data without permission.
• Attempt to reverse engineer, disrupt, scrape, overload, or interfere with the Service or its infrastructure.
• Create fake accounts or use bots, scripts, or automation to access the Service.

4. User Content

You retain ownership of the content you submit, including profile text, photos, messages, and other materials ("User Content"). You grant MyNextEx a non-exclusive, worldwide, royalty-free license to host, store, reproduce, and display your User Content solely for the purpose of operating, improving, and protecting the Service.

You are solely responsible for your User Content and represent that you have the right to submit it.

5. Content Moderation and Safety

We may review, remove, restrict, or moderate content and accounts to enforce these Terms, protect users, comply with law, or preserve platform integrity. We may use a combination of automated tools and human review.

We are not obligated to monitor every interaction, and we cannot guarantee that all user content or behavior will be safe, accurate, or appropriate.

6. Messaging, Matching, and Interactions

MyNextEx provides tools for introductions, matching, and messaging, but we do not guarantee matches, responses, compatibility, or outcomes. You are solely responsible for your interactions with other users, online or offline.

7. Paid Features and Purchases

If paid subscriptions or in-app purchases are offered, billing and refunds are handled by the applicable platform provider, such as Apple or Google, unless otherwise stated. Pricing and features may change over time.

8. Termination and Suspension

We may suspend, restrict, or terminate your account, or remove content, at any time and without prior notice if we believe you violated these Terms, created risk for other users, exposed us to legal liability, or misused the Service.

You may stop using the Service at any time. Account deletion requests may be sent to privacy@mynextex.com.

9. Disclaimers

The Service is provided on an "as is" and "as available" basis. To the maximum extent permitted by law, MyNextEx disclaims all warranties, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, availability, accuracy, and security.

10. Limitation of Liability

To the fullest extent permitted by law, MyNextEx and its affiliates, officers, employees, and contractors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of data, profits, goodwill, or business opportunities arising out of or related to your use of the Service.

To the fullest extent permitted by law, our total liability for any claim relating to the Service will not exceed the greater of fifty U.S. dollars (US $50) or the amount you paid to MyNextEx, if any, in the twelve months before the claim arose.

11. Indemnification

You agree to defend, indemnify, and hold harmless MyNextEx and its affiliates, officers, employees, and contractors from and against claims, liabilities, damages, losses, and expenses arising out of your use of the Service, your User Content, or your violation of these Terms.

12. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may notify you through the Service or by other reasonable means. Your continued use of the Service after updated Terms become effective means you accept them.

13. Governing Law

These Terms are governed by the laws of the State of California, without regard to conflict of law principles, except where applicable law requires otherwise.
